Outline of Research at the Start	知的財産権侵害に対する金銭的救済として、損害の賠償を越える追加的賠償（利得の吐き出しや三倍賠償等）を新たに導入することの是非について検討する。これまで我が国では、填補賠償の原則の下、損害を越える賠償は認められてこなかったが、まず知的財産権の故意侵害と過失侵害を峻別し、また損害賠償制度の果たすべき機能として故意侵害の抑止を正面に据えることを通じて、立法論への貢献を図る。そこでは、追加的損害賠償の侵害抑止機能に関する基礎理論を踏まえること、法と経済学の手法を用いて効率性基準から機能的な検討を行うこと、そしてすでに懲罰的損害賠償制度を持つ諸外国から日本法への示唆を探ることが目指される。
