Outline of Research at the Start

本研究は、競争者が商標を選定する自由領域を確保し、需要者のサーチコストを削減するという標識法の目的を達成するために、識別力概念の取扱いの再検討を試みるものである。近時の米国等における先行研究によれば、識別力が高く登録が容易に認められる商標や、使用を通じて識別力を獲得したことを理由に登録が認められる商標の中には、言葉の生来的な意味に鑑み、独占に馴染まないものが含まれている可能性がある。そこで、日本法において、これらの商標の登録要件を厳格化することの是非を検討する。
