Outline of Research at the Start	国際環境法学では、環境損害を未然に防止する義務の確立が盛んに論じられてきたが、従来は、他国の環境や国際公域の環境に対する越境損害の防止に焦点が当てられてきた。だが近年では、地球規模の環境問題や人権侵害に対するより効果的な法的対応が模索される中で、国際法上の防止義務の射程が自国内の環境にも及ぶかという点も、重要な論点となりつつある。こうした国内環境損害の防止義務には、「環境の一体性」を根拠とする義務と、「人権」を根拠とする義務の、大きく２つの異なる系譜を指摘できる。本研究では、両者の発展状況をふまえて、相互の関係や差異に綿密な検討を加え、国際法上の環境損害防止義務の理論のさらなる精緻化を試みる。
