Outline of Research at the Start

本研究は、信認義務という視点で個人情報保護を検討するものである。従来、本人の同意によって個人情報保護法を図ってきた。しかし、プラットフォーム事業の隆盛により、その制度設計が困難になっている。本研究では、その困難を克服するために、信認義務（特に忠実義務）を個人情報保護法制に取り込むことを検討する。
本研究を実施するために、個人情報保護の文脈で信認義務の観点を導入するための法律構成と信認義務を導くための法的根拠を検討し、現行の個人情報保護法制に不足している要素を見つけてそれを再構成することを検討する。それにより、本人の同意の下で取得された個人情報が転々と流通した場合の保護を図ることが期待できる。
