Outline of Research at the Start

本研究の目的は、日本の消費者法が、持続可能な社会の構築という世界的な課題を解決するためにどのように貢献できるのかを検討することにある。近年、EUでは消費者法分野でも持続可能な社会を実現するための立法や研究が進展している。例えば、契約における消費者の救済手段として交換する権利よりも修理する権利を優先することや、不要な買い替えを促すような契約条項の規制やグリーン・ウォッシュの規制が、提案あるいは実現されている。本研究においては、EU法を対象とした比較法的考察及び国際法からの検討を行うことによって、持続可能な社会を構築するために日本の消費者法に求められる政策と立法に向けた提言を行うことを目指す。
