特許権侵害訴訟は専門部（東京地裁と大阪地裁）の専属管轄となっているのに対し、商標権や著作権侵害訴訟は、専門部と非専門部（東京・大阪以外の地裁）のどちらの裁判所にも管轄が認められている。全国の地方裁判所に保管されている未公開の判決を網羅的に収集し、知的財産法に特化した専門知識を持つ裁判官とそうでない裁判官の判断を比較分析することで、非専門部の裁判官が知的財産訴訟を審理判断することにはどのような意義があるのかを明らかにする。
