Outline of Research at the Start	本研究ではドイツの国内裁判所、欧州司法裁判所、欧州人権裁判所において、「比例性」がいかなる基準としてどのように適用されてきたのかを明らかにし、そこで明らかになっ「比例性」概念が投資保護協定の各規定との関係でどのように適用されるべきか、各規定の条文の構造や起源、制度趣旨、対象とする国家による措置に共通点があるか否かを検討する。
