Outline of Research at the Start

企業活動のグローバル化や急速なデジタル化の中で、多くの国家が、自国領域外の事象に対しても、自国規制の規律を及ぼすようになっている。こうした「域外適用」は、複数国の規制法規の競合・衝突を招く恐れがあるため、各国規制法規間の関係をいかに調整すべきかが重要な課題となっている。本研究は、この課題への対応として、政治性が存在しない「かのように」法秩序間の私法抵触を解決する抵触法（国際私法）の有用性を探るべく、①抵触法の特徴の一つと主張される「技術性」の意義・機能を明らかにした上で、②「技術としての抵触法」という視座から、各国規制法規の抵触を分析し、その調整へと向けた具体的な処理方法の提唱を目指す。
