国際投資法の核心である投資条約は、外国投資家に対して一定の保護を提供し、投資紛争を仲裁によって解決することを特徴とする。この制度は、国際法においては特異なほどに強力な保護を私人に与えており、途上国だけでなく先進国からも批判を受け、変容の只中にある。国際投資法の意義と将来を理解するためには、国際投資法が外国投資家に特別な保護を提供する理由とその目的を理解することが必要となっている。本研究は、法的・歴史的・実証的なアプローチを通じてこの問いに一定の答えを与えることを目指す。
