Outline of Research at the Start

本研究は、既存の国際経済法では対処し難い新たな課題群が出現し諸国がその対応を模索する中で、国際経済法における公正の概念にいかなる変化が生じつつあるのか、そしてその変化が国際経済法の規範構造にいかなる影響を及ぼすのかを解明することを目的とする。以上の目的を達成するために、まず、国際経済法上の公正概念の起源や特質を歴史的文脈の中で捉え直し、概念の変容を捉えるための準拠枠組を確立する。そのうえで、今日公正性を巡る論議が活性化している非市場経済慣行、経済安全保障、持続可能性などの各課題領域ごとに公正概念の変容の有無と程度を分析する。最後に、公正概念の変容が国際経済法の規範構造に及ぼす影響を考察する。
