Outline of Research at the Start

本研究では、正当防衛と緊急避難の法的性質の差異や第三者のための緊急行為をめぐる議論を踏まえながら、「緊急行為者」「相手方」「保護対象者」のそれぞれの観点から利益衝突状況を多角的に分析することで、招致された利益衝突状況に置かれた各人に認められるいかなる事情が正当化の判断に影響を与えるのか、そして、それがいかなる理論的根拠から統一的に説明されうるのかを明らかにする。
