Outline of Research at the Start

本研究は、英米量刑法の生成と構造（立法経緯と現在の制度構造）を体系的に記述する比較法研究であり、それを通じて、①わが国における量刑立法の要否を検討すること、および②わが国の量刑実務の改善に向けた提言を行うことを目的とする。英米量刑法は、量刑上考慮すべき諸事情を法定するだけでなく、その考慮の結果として「どの程度の刑を科すべきか」という判断の領域（刑の数量化）にまで詳細な法的統制を及ぼす点で、ドイツ等の大陸法諸国には見られない独自性をもつ。本研究は、こうした英米量刑法の知見から、刑の数量化に関する立法の要否と、刑の数量化のあるべき手法について示唆を得ることで、上記目的を達しようとするものである。
