Outline of Research at the Start

本研究の目的は、教育的必要に基づく教育条件整備基準、及び、その基準を保障する教育財政制度を、歴史研究、判例研究、比較研究を通して明らかにすることにある。近年、戦後教育改革を通じて構築された教育財政制度に、教育人権保障の仕組みを見出す研究が注目されつつある。本研究では、戦後教育財政制度における教育人権保障の仕組みの根幹をなしていた「教育的必要に基づく教育条件整備基準」が当時いかにして導かれ、また、今日においてはいかにして導かれうるのかに迫る。さらには、戦後の沖縄県及び1920年代以降のアメリカにおける教育財政制度の理論と法制を、本土のそれと比較する手法をとる。
