Outline of Research at the Start

鈴木安蔵は、自由民権運動研究の先駆的歴史学者、及び戦後の「憲法草案要綱」起草に携わった憲法学者として知られる。本研究の目的は、鈴木の旧蔵資料・関係資料が未整理のまま全国に分散して所蔵されていることが判明したのを機に（１）これら資料群並びに鈴木の著作を網羅的に調査し、（２）鈴木の①自由・権利思想、②福祉国家思想を軸に、思想史的方法で分析を行い、日本の民主化過程を検討することにある。歴史学・憲法学両分野において部分的にしか顧みられてこなかった鈴木の思想を再検討し、戦前から戦後における連続性と断絶性の位相を歴史的文脈の中で明らかにするとともに、現代の法・政治哲学への接続を試みる。
