Outline of Research at the Start

事前規制としてのEUデータ法制（GDPR,DGA, DA）等の公法（ハードロー）と、我が国でのAI・データ契約ガイドライン（以下GL)等の私法（ソフトロー）の修正と、役割分担を、以下の4点から検討する。①処理AIから生成AIへの変化やオープンデータなどの新しい動きをふまえつつ、②EUデータ法制およびGLの法構造を分析し、当事者の利害対立の構造を明らかにした上で、その適用範囲および法的課題を考察する。以上の実態調査をもとに、③データ法制の基礎理論を再検討し、④データ共有の実装の各論（医療健康データ、行政データ、メタデータ等）から検証する。
