Outline of Research at the Start

法伝統をはじめとした様々な国内要因は、各分野の国内制度の形成にどのような影響を及ぼしているのであろうか？ 一般的に英米法（大陸法）の伝統を有する国家が、特定分野において大陸法（英米法）的な国内制度を有することがあるのか、あるとしたら、それはなぜか。この問題が重要なのは、ほぼ全ての国際関係論の既存研究は、英米法伝統を有する国家は英米法的な国内制度を有していると「仮定」しているが、それが誤りであることを示すことになるからである。本研究では、法伝統と国内制度の関係に関するブラックボックスを開けることを試みる。
