Outline of Research at the Start	本研究は第一に、近時の合衆国最高裁の判例動向の分析を通じて、保守的な司法権観念の構造と変容の態様を定式化する。具体的な局面として（A）当事者適格の認定、（B）司法判断における基準・考慮要素、（C）違憲・違法判断の際の司法的救済という3つの各論を取り上げる。共通のモチーフとして①「具体性」の要求、②静態性志向、③その帰結としての司法部門の機能の限定・縮小化、といった仮説を有しているが、その精緻化を図る。第二に、前記作業で定式化した司法権観念の変容がいかなる政治的・社会的要請の下でもたらされたのかを検討する。とともに、そうした変容を正当化するロジックが提示された法思想史的な文脈を解明する。
