Outline of Research at the Start

本研究は中国における法の実現のあり方を、「法律監督機関」と性格づけられる検察（人民検察院）および民事法という中国的特色が濃厚な対象に着目し、明らかにしようとするものである。具体的には5年の研究期間中に、民事法の実現に関わる「民事再審制度」、「民事公益訴訟制度」および「民事提訴支援制度」という3つの制度における検察の役割を考察する。本研究により、中国における法実現メカニズムの一端およびその比較法的特徴を明らかにできるのみならず、さらには中国の法システムの存立構造に切り込むことも期待できる。
