Outline of Research at the Start

本研究は、近代民法の法典化について、エジプト、インド、モンテネグロを対象とし、コモン・ロー圏を含めたグローバルな動きの中に、日本法を含めた法の近代化を位置づけることを目的とする。各地域が法を西洋化していく過程で非西洋法的要素をいかに扱うかという共通課題を抱え、それに対して異なる解答を出したこと、その背景に、複数地域の法典化に関わる人物、特に混合法地域出身の法律家とそのネットワークが存在することを明らかにする。イスラム法研究者、インド法研究者と西洋法制史・ローマ法研究者が相互協力することにより、各地域の法典化を比較し、その連関を明らかにし、法の近代化をよりグローバルな視点から実証的に解明する。
