Outline of Research at the Start	本研究は法律学の基本概念のひとつである「衡平」にかんして、その概念の受容と変遷の過程を解明しようとする思想史的研究である。時代としては中世盛期13世紀から初期近代17世紀初頭まで、地域としてはイギリスを除くヨーロッパ世界を想定している。具体的には、フランシスコ・スアレスの著作『法律および立法者たる神についての論究』をおもな素材として、スアレスとその周辺に位置する哲学者・法学者たちの文献を網羅的に参照することにより、衡平概念の総合的な理解に努める。またその視角から、現代の法律学では見失われている衡平の意義や機能について再考を促す。
