Outline of Research at the Start

夫婦財産法は、西欧ではローマ法以来一貫して、家産の中核に関わる最重要な法領域であり、そこで高度な法技術が緻密に練り上げられてきた。本研究は、夫婦財産法について、ローマ法に溯る提要システムから19世紀のパンデクテン・システムまで、法体系上の配置方法に焦点を絞り、この制度の性質がどのように変化したのかを図式的に表す。さらに、西欧法を継受した日本民法典は、立法過程でシステム転換をしたが、夫婦財産法は影響を受けたのか、Legal Transplant（法移植）の観点から批判的に再検討し、比較法学史の中に再定位する。
