Outline of Research at the Start

本研究は、国家賠償責任及び種々の損失補償責任の、理論的、原理的あるいは実定法上の根拠はいかなるものであるのか、という問いについて、①国家補償全体に通底する原理的な根拠（公平負担の前の平等の原則等）や、②国家賠償責任の理論的な根拠（過失責任、違法責任、危険責任、報償責任等）、③種々の損失補償の原理的あるいは実定法上の根拠（憲法13条、14条、25条、29条3項等）等を、各責任・加害行為・損失等の類型ごとに探求・整序することにより、その議論のあり方を体系的な形で提示することを試みるものである。
