Outline of Research at the Start

本研究は、政府が言論者として振る舞う「政府言論の法理」の射程を明らかにすることで、 憲法上国家に求められる「中立性の原理」の限界を明らかにすることを目的とする。中立性の原理は、 リベラルな国家における公と私の領域の区分を可能にする概念として広く承認されてきたが、見解の中立性が要請されない政府言論の法理との関係性が明らかではない。そこで本研究は、アメリカの憲法理論の検討を通じて、政府が言論を通じて非中立的に振る舞うことができる領域を明確にすることをねらいとする。
