Outline of Research at the Start

わが国の行政法の大きな課題の一つは、行政訴訟における救済方法が柔軟性に欠けることであり、その弊害として、裁判所が本案審理の段階で公益に配慮して広汎な行政裁量を容認せざるを得ないことが考えられる。この課題を解決し、延いては行政訴訟における違法判断を積極化させるため、行政活動の司法審査における救済方法（remedies）の形成に係る司法裁量について、豊富な判例の蓄積のあるイギリス法及びオーストラリア法を参照した実証的な比較法研究を行う。
