Outline of Research at the Start

超高齢社会を迎え、社会保障の水準が低下し、インフラサービスの維持も困難となりつつある日本において、生存権に関する憲法判例に大きな進展は見られない。しかし、南アフリカなどのグローバルサウスの国々では、国ごとの差異はあるものの、社会権ないし生存権に関する違憲審査は活発化しているといえる。日本において生存権を実効的に保障する上で、これらの国々の判例の動向は示唆に富む。そこで、本研究では、司法による実効的な生存権保障のための理論枠組みを構築するべく、社会権の分野において高い国際的関心を集める南アフリカ憲法判例を素材として生存権の規範内容及び違憲審査の手法について検討する。
