Outline of Research at the Start	自己決定の能力が低下していると見られる患者の医療についての意思決定にかかる法制度を主たる対象として、憲法上の自己決定権（個人の自律の保障）や生命・身体に対する権利（個人の存在の保障）などの基本的人権の保障の観点から、いかなる実体的及び手続的要請があるのかを探究する。それにより、あらゆる患者を「個人として尊重」するために、医療上の意思決定にかかる法制度を形成する立法政策に基礎的な指針を提供したい。
