Outline of Research at the Start	国家法としての行政法は、今日、一定の行政活動に対して有効な法的規律を及ぼすことが困難になっている。現在、行政法の課題の一つは、これらの行政活動に対し如何に授権し統制を及ぼすかである。そこで、本研究は、国家法ではなく非国家法（私的団体が定立した自主ルール）に焦点をあて、「自主ルールそれ自体の内部に公法的価値を実現するルール群（非国家法としての「行政法」（名を与えられる前の行政法）の生成を見いだす」という自主ルールに内在的な自己拘束のアプロ―チを採る。これにより、行政法が有する公共的価値の実現と、自主ルールと「行政法」とが有する個別の価値とが両立しうる、統一的な法構造の構想が可能となる。
