Outline of Research at the Start	行政庁が行政処分を行う際に、具体的にどのような事項についてどの程度の調査義務を負うのか、また、行政処分を行った後にも、それが誤っていないかを見直すために引き続き調査義務を負うのか、それはどの程度の義務か、等の問題は、いまだ十分に解明されていない。総務省行政不服審査会においては、様々な個別法について、行政庁が必要な調査検討を尽くしたか否かという観点から判断が示され、多数の答申例が蓄積している。本研究は、これらの答申例等を手がかりとして、行政庁の調査義務の具体的なあり方を解明し、理論上も実務上も未開拓であった問題の解決を通じて、行政法学の発展に寄与するものである。
