Outline of Research at the Start

受刑者の選挙権制限の合憲性をめぐるこれまでの裁判では複数の立法目的が取り上げられてきたが、実際の制定者意図がいかなるものであったかは未解明である。本研究は、公職選挙法制定当時（1950年）、さらにはその原型である衆議院議員選挙法制定当時（1889年）の受刑者の選挙権制限をめぐる制定者の意図を実証的に解明する。その上で、これまで語られてきた複数の立法目的（制定者意図を含む）のうち、代表民主政を統治の骨格とする憲法の下で本来特段の尊重に値するはずの選挙権を剥奪するのに十分な資格を持つ（または持たない）のはいずれかにつき、海外の議論をも参照しつつ、考究する。
