Outline of Research at the Start	公海ガバナンスは旗国主義によって支えられているとされてきたが、資源保護や通信など海洋におけるいくつかの分野で旗国を想定しない規律（「旗国なき公海ガバナンス」）が構築されつつある。本研究課題は「旗国なき公海ガバナンスをいかに構想すべきか」を問いとしつつ、旗国管轄権の排他性の基盤を探求することを通じて、旗国主義の限界とその代替を検討・考察する。そのうえで、公海における新しい「権限の分有」のあり方を提示することとしたい。
