Outline of Research at the Start

本研究は、搾取規制・優越的地位濫用規制を構造的に検討し、比較法研究を行うことを通じて、国際的にも搾取規制をめぐる議論をリードすることを目指す。
日本の優越的地位濫用規制は、しばらく前まで、日本特殊な規制であるという整理が有力であったために、理論的精緻化が相対的に遅れている。ところが、近年、巨大デジタルプラットフォームによる搾取問題が注目されて、競争法上の搾取規制に焦点が当たり、欧州を中心に重要事例も相次いでいる。そこで、本研究は、日本の優越的地位濫用規制の蓄積を生かして、議論をリードするとともに、日本の搾取規制の構造的理解、それに基づくより精緻な搾取規制に係る比較法分析を行う。
