Outline of Research at the Start

AIの作動により法益侵害が生じる機序の確認。AIを利用する自然人、アルゴリズムにより作動するAI,そのいずれが法益侵害につき因果関係を有するのか、その前提としての因果関係の概念把握、過失概念を法と経済学的に再構成すること、これに加え、特別予防目的論をも踏まえ故意概念を再構成すること、AIに対する制裁として、刑罰に分類可能なものの確認、AI、法人、自然人の比較を通じて、刑事制裁の対象となるべき人格の意義の確認。
