Outline of Research at the Start

本研究では、より良き立法の実現に向けた刑事立法の分析枠組みを構築する構想の一環として、刑法学、憲法学、行政学の共働による学際的研究を実施する。刑法学と憲法学との共働では、刑法の基本原則は憲法上の地位を有するのかなど、日本国憲法の解釈論として、日本国憲法が立法者にいかなる制約を課しているかを検討する。刑法学と行政学との共働では、人事分析の手法を用いて、刑事立法にかかわる各アクターの選好を明らかにする。その上で、様々な専門知を立法過程に環流させるのに有効な制度のあり方を検討する。
