Outline of Research at the Start

本研究では、詐欺罪の要件解釈において客観的帰属論が役割を果たしうるか、果たすとすればどのような役割かを考察する。その中心的な問いは「客観的帰属論は、詐欺罪の構成要件解釈において、何をどこまで解決し得るか？ 」である。客観的帰属論は、刑法上の因果関係に関する一理論と解する見解が多いが、この理論は社会的視点に即した刑法の解釈図式を提示するものといえ、本来、その射程は因果関係論を超えて犯罪論全体に及びうる。本研究は、詐欺罪を対象に客観的帰属論のそのようなポテンシャルを検証するものである。
