Outline of Research at the Start	本研究は，日本における，私人による利益の剥奪（利益の吐出し）に関する一般法理を究明するものである。具体的には，①私人の利益剥奪請求権の発生要件および効果に関する基本枠組み，②個別の紛争類型ごとの要件および効果の具体的内容，ならびに③それらを規範的に正当化しうる統一的な法原理を探求することをその目的とする。以上のような目的を達成するために，本研究では，①この点に関する日本の従来の判例および学説による議論ならびに②特に，近年，目覚ましい発展を遂げているドイツ法，さらにはヨーロッパ法における議論を，網羅的・体系的・立体的に整理・検討する。
