Outline of Research at the Start

令和6年5月の民法改正により、離婚後も父母が親権を共同して行使することが可能になった。これを契機として、親権・監護権の行使のあり方等について関心が高まっている。本研究は、①父母が親権を共同行使・単独行使する場合・場面、②親権・監護権の具体的な内容、監護者が指定された場合の監護者の権限、③子の監護に関する事項（在学契約、医療における診療契約など）の法的性質という3つの事項の明確化を目標とする。
