Outline of Research at the Start

本研究は、一定の情報の私法上の取り扱いについて、従来の研究のような (a) 国際的なルール動向の参照や (b) 所有権など伝統的な法概念の精緻化ではなく、効用最大化を基準とする法と経済学の議論から不完備契約論を用いることで、社会的に望ましい「情報の『所有権』」を新たにデザインすることを目指す。具体的には、情報の類型ごとに、情報の生産・収集・伝達・利活用の過程と社会にどのような利益を与えるかを分析し、かかる分析を基に、情報が社会に利益となるために必要となる行為を負担する主体に、行為によって生じる社会的利益を帰属させることで、主体がかかる行為を行うインセンティブを提供するというものである。
