Outline of Research at the Start	本研究は、成年後見制度における意思決定支援・身上保護も重視した制度の運用について、ドイツ法なども参考に制度の運用改善や制度の改正の必要性について検討し、提言を行うものである。より具体的には、障害者権利条約が求める意思決定支援を実現するための、成年後見人の法律上の行為基準を明確化し、さらには、身体に対する強制を伴う事項について、障害者権利条約の趣旨も踏まえた上での法的対応の在り方について考察する。
