Outline of Research at the Start	不法行為等の加害行為によって、被害者に、損害だけでなく、利益も生じることがある。この場合に、損害賠償額を定めるに当たって、損害から利益を控除することを損益相殺という。民法には規定はないが、損益相殺という概念自体は、今日の学説判例において、広く承認されている。この損益相殺は理論的な研究が不十分であり、外国法との比較などを通じて、研究を進める必要がある。もっとも、法制度の枠組みは国によって異なっており、単純に比較できるものではない。そこで、本研究は、損益相殺が前提とする法枠組みについて研究を行い、比較法研究のための基盤を整えることを目標とする。
