Outline of Research at the Start

近時の法改正によって、家事調停には、共同親権制度の導入、Web会議の利用という新たな要素が加わり、その審理のあり方に大きな変化が生じる可能性がある。共同親権の導入は親権に関し、これまでの関係断絶的な話し合いを関係継続的な話し合いに変化させ、Web会議の利用は、非言語的要素の欠落により、情緒的要素の伝達を難しくする。本研究は、家事調停で、このような変化に合わせどのような調停技法を用いなくてはならないのかという問題に関し、手続的公正研究の成果と、調停技法や弁護士の面接技法に関する 研究といった異なる研究領域を融合させることによって新たな調停技法を探求し、加えて、その効果の検証を目指すものである。
