Outline of Research at the Start

本研究では、ドイツ契約法にみられる現代的な展開について、その理論動向を、さらに法改正の動向も踏まえて分析する。その際、とりわけ、EU法（現代化指令、判例の蓄積）の展開に注目し、ドイツでの個別の契約ルールの変遷の意味を把握することに努める。さらに、こうした法現象を踏まえて、消費者法の展開も踏まえた上で、契約法の現代化現象の理論的分析を通して、市民社会の生活基盤となる「契約法」の新たな姿を構想することを意図している
