Outline of Research at the Start

本研究は、成年後見制度の現代的な変容を受けて、遺言代用信託をめぐる重要な法的問題点につき、多様な遺言代用信託の形態に応じて類型化したうえで、意思決定支援の実務、関連する他の法制度との整合性および比較法的視座にもとづく分析を通じて、解明するものである。具体的には、①委託者による遺言代用信託の設定・変更・終了に必要な能力の基準、②判断能力が減退した委託者が、意思決定支援を受けて、遺言代用信託を設定・変更・終了することの可否、③制限行為能力者が受託者その他の信託関係人に就任したときの法律関係、④遺言代用信託を自己信託により設定することの可否を検討するものである。
