Outline of Research at the Start

本研究は、著作物の例示規定の役割と例示規定のあり方を考察するものである。3つの視点からアプローチしていく。第一に、比較法の視点から、日本、イギリス及び中国の法理論と裁判実務を比較的に検討すること。第二に、技術と法の歴史的発展の視点から、創作手段に関わる新技術の普及が著作権法にどのように影響してきたのかを整理し、技術の革新がもたらした創作活動の実態の変化に応じた著作物の例示規定の在り方を議論する。第三に、異なる文化的背景の視点から、著作物性判断における「創作性」要件の基準が著作物のカテゴリーや国（地域）によってどう異なるかを検討する。
