Outline of Research at the Start

本研究では、インターネット技術やクラウドコンピューティングなどの進歩を背景に喫緊の課題となっている、ネットワーク上で行われる国境を跨いだ知的財産利用行為について、いかなる場合に我が国知的財産権侵害（「越境侵害」）の成立を認めるべきかという問題を扱う。すなわち、複数の端末・機器が国境を越えて分散的に配置されるとともに、その間をつなぐネットワークを駆使して複数の外国市場に参入し、国際的にサービスを展開する事業者が急速に増加する中、知的財産の利用行為が国境を跨いで行われる場合に、日本法による保護が認められるのはいかなる場合かを、知的財産法横断的に考察するものである。
