Outline of Research at the Start

本研究は、再エネ促進策の陰で生物多様性への負荷が一層増す時代にあって、生物多様性保全の実質化を確保するとともに、再エネ拡大というもうひとつの環境的価値との最大限の両立を可能とする法理論を探究するものである。生物多様性保全法上の規制のみに拠ることの限界をふまえ、許認可等に先立つ上位の計画段階から再エネ事業の実施に至る一連の行政過程全体をつうじて生物多様性への配慮を最適化する余地を探るところに、本研究の特色がある。ドイツ法を参照しつつ、行政過程全体での生物多様性への配慮の総体を構造的に明らかにし、それを生物多様性保全の実質化という観点から分析・評価する。
