Outline of Research at the Start

本研究は、国際人権法に基礎をおいたマイノリティの人権に関する総合的研究である。マイノリティの人権の保障を阻む要因として、現代の法と法学に過去の入植者植民地主義（セトラー・コロニアリズム）が潜んでいることが挙げられる。
本研究は、この重要な視点を踏まえて、共同研究メンバーが各自の専門的知見からマイノリティの人権に関する法と法学を多角的に検討し、その法に植民地主義がどのように潜み、それを法学がどのように支持してきたかを明らかにする。そうすることで、本研究は、あるべきマイノリティの人権保障のあり方、権利救済の方法などを提示し、法と法学がより公正と正義を目指す姿に発展する方向性を示すものである。
