Outline of Research at the Start

司法におけるジェンダーバイアスの特徴を、判決文を分析して解明することを目的として、近年の刑法性犯罪規定改正による法規範の変化とそれによる社会規範の変容を、判決文の分析によって明らかにする。社会規範の変容を捉えるため性犯罪規定の改正前と改正後の判決文、および他の暴力犯罪の判決文を分析対象とする。ジェンダーバイアスを判定する準拠点を性暴力に関するグローバルスタンダードとしての国際人権基準に求める。計量的方法と質分析的方法の両面から可視化・析出し、言語的連関や構文。文脈といった言説構造を解明する。成果を外形的にバイアスの存在を示唆する指標として利用可能な形にして社会に還元することを目指している。
