Outline of Research at the Start

いじめ重大事態調査は、教育的見地に立った調査であり、法的責任追及等を直接の目的としたものではない。にもかかわらず、多くの訴訟において調査報告書が証拠として提出される等、その「理念（＝教育的視点の調査）」と「現実（＝法的責任追及の手段）」の乖離が顕在化している。本研究は、重大事態調査に当たる委員,弁護士の視点を交え、教育学と法学の学際的視点から、この乖離にアプローチする。乖離が何に起因し、重大事態調査にどのような影響を与えているのか。その解消にはどのような対策を講じる必要があるのか。これらの点について調査、分析し、その結果を用いて重大事態調査の円滑な実施に向けたモデルを構築する予定である。
