Outline of Research at the Start

従来、近世の刑事法学(司法)は、近代的な刑事法学と図式的に比較され、その断絶が強調されてきた。しかし、近世刑事法学の研究が進む中で、そのような見方には修正が迫られている。本研究では近世刑事法学において提唱されていた「例外犯罪論」の分析を通じて、近世刑事法学(司法)の特徴を析出する。その際には、大学法学部で作成された学位論文や討論録などの史料を用いて法学内部の議論状況を比較すると共に、実務における影響も検討する予定である。
