Outline of Research at the Start

私人の遂行する任務を行政主体が引き受ける「公共化」の場面では、主に①これを決定する行政機関が利益相反的な地位に立つことによる公共化決定の公正さの確保（特にその判断過程における考慮事項の観点）、②公共化後の任務遂行組織の形成にあたって、公共化の目的その他事情に適合した組織裁量の行使が問題となりうる。本研究では、特に公共化が積極的に論じられるドイツにおける公共化の事例を分析するとともに、ドイツ公法学の議論を参照しつつ、上記の諸論点につき、行政法各論の観点から検討し、行政領域（エネルギー供給・水道供給・公営住宅供給）ごとの異同を考察することを目的とする。
